Procedure:
In accordance with section 13 of the Industrial Relations Act 1969 (as amended), this dispute was assigned to me for investigation by the Director General. The subject matter is a dispute under section 13 of the Industrial Relations Act 1969 and the parties are not named. In accordance with section 8 of the Industrial Relations Act 1990, they are referred to as “the worker” and “the employer.”
A hearing was arranged for Friday, March 27th 2026 at 11.30. By 12.00 midday, neither party was in attendance and they did not contact the WRC to explain their failure to attend. I examined the case file and I noted that, on January 29th 2026, both parties were notified of the date and time of the hearing on March 27th. The correspondence sent to the employer was returned undelivered and it is apparent therefore, that the employer was not on notice of the hearing.
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
In the circumstances in which the worker did not attend the hearing, I recommend that the parties take no further action regarding the matter in dispute. |
