Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute(s) to me by the Director General, I inquired into the dispute(s) and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute(s).
Background:
This dispute was set down for a full day to assist the parties with a difficult trade dispute involving a family business. The parties had agreed to participate in an extended day hearing so that a framework agreement could be reached that would form the basis of a final agreement to a lengthy and difficult dispute. The worker failed to attend and on contacting him some days later he stated that he was not in a position to attend. No contact had been made with the Commission to explain his failure to attend. His non-attendance in turn has collapsed an agreed process. In these circumstances it is not possible to make a recommendation where the party who has referred the matter to the Commission fails to attend. |
