Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint. The matter was scheduled to be heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. 359 of 2020, which designates the WRC as a body empowered to hold remote hearings.
Background:
The complaint is that the Complainant was unfairly dismissed for gross misconduct.
The Complainant was notified of the date, time and scheduled platform for the remote hearing. When the Complainant failed to attend, efforts were made to contact her by phone to no avail.
The hearing was closed at 10.20am.
The Respondent confirmed that the correct name of the employer/respondent is Cork Simon Community.
Findings and Conclusions:
Having been notified of the arrangements to hear her complaint, the Complainant failed to attend the hearing or provide an explanation. In the circumstances, I find that her complaint has not been prosecuted by her and is not well founded.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
Based on the findings and reason above, I have decisded the complaint is not well founded.
