Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
A hearing was arranged to investigate a complaint brought under the Payment of Wages Act and neither the Complainant or the Respondent attended the hearing.
I am satisfied that the Complainant and the Respondent were properly notified of the date, time and place of the hearing. |

The Complainant failed to attend the hearing. |

The Respondent failed to attend the hearing. |
Findings and Conclusions:
The Complainant emailed the Commission to state that he had misjudged the travel time to the hearing. The Complainant failed to attend to present his complaint. In these circumstances as the reason provided for non-attendance is traffic congestion, I dismiss the case for failure to attend. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is not well founded. The Complainant failed to attend to present his complaint. In these circumstances as the reason provided for non-attendance is traffic congestion, I dismiss the case for failure to attend. |
