Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 8 of the Unfair Dismissals Acts, 1977 – 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The Complainant did not attend the hearing. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing. It is not clear whether they were on notice of the hearing. A notification letter was sent to one of their trading addresses but, due to the way the Complainant filled out the complaint form, it was addressed to the Complainant rather than a nominated person still in the Respondent’s business. |
Findings and Conclusions:
Section 8c of the act provides as follows: An adjudication officer to whom a claim for redress is referred under this section shall— (i) inquire into the claim, (ii) give the parties to the claim an opportunity to be heard by the adjudication officer and to present to the adjudication officer any evidence relevant to the claim, (iii) make a decision in relation to the claim consisting of an award of redress in accordance with section 7 or the dismissal of the claim, and (iv) give the parties to the claim a copy of that decision in writing. I am satisfied that the Complainant was given an opportunity to be heard in this matter. A hearing notification was sent to the email address provided in their complaint form and that complaint form provided that the WRC could notify them of a hearing by way of email. Despite this the Complainant did not attend the hearing to present their case. I dismiss the claim. |
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I dismiss the claim. |
