Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant stated in his submission that: I am employed as a Depot Operative since 06/11/2017. I am making a complaint under the Payment of Wages Act due to an ongoing issue of unequal pay for equal work and an unfair bonus scheme (BSI) that directly impacts my earnings.
He was notified of the date, time and place of the hearing at the email he provided, and he consented to email communication and he failed to attend at the hearing or to contact the Commission about his absence. |
Summary of Complainant’s Case:
The Complainant failed to attend at the hearing to make out his case. |
Summary of Respondent’s Case:
The Respondent attended and was ready to rebut the allegations being made against them. |
Findings and Conclusions:
The Complainant consented to email communication and was properly notified of the place, date and time of the hearing. As the Complainant was properly notified of the hearing and failed to attend, I must dismiss his complaints. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I determine that the complaints are not well founded arising from the non-attendance by the Complainant at the hearing. |
