Procedure:
In accordance with Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
In his complaint form to the WRC, the Complainant stated that he began his employment as a Service Desk & Cloud Support Engineer with the Respondent on 4 January 2023. He asserted that his dismissal on 29 April 2025 was both substantively and procedurally unfair. |
On the morning of the hearing at 8 33am, the WRC received the following email from the Complainant’s representative’s email address:
Dear WRC postponements,
We seek to adjourn on consent the WRC adjudication hearing in the above matter to another date in September of October 2026 on consent.
Eversheds Sutherland LLP represent the Respondent.

No explanation was provided in support of the postponement request. As the Respondent was present and ready to proceed at the scheduled commencement time of the hearing, I decided to refuse the application for a postponement.
In circumstances where the Complainant did not attend the hearing and, consequently, did not give evidence in support of the complaint, I find that the complaint has not been made out and must fail.
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
The complaint fails for the reason set out above. |
