Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. No. 359/2020 which designates the WRC as a body empowered to hold remote hearings. The complainant and a witness for the respondent undertook to give evidence under affirmation. This complaint was heard along with ADJ-00058438 and the evidence provided in relation to that complaint was heard at the same time as this complaint. |
Summary of Complainant’s Case:
CA-00071115-002 Payment of Wages The complainant confirmed that there was no loss of earnings in respect of her complaint. CA-00071115-003 Unfair Dismissal The complainant confirmed that she was not employed by the respondent since January 2021 |
Summary of Respondent’s Case:
The respondent conceded that it had not informed the complainant that her employer had changed in 2021, either at the time or since. CA-00071115-002 Payment of Wages The respondent that there was no loss of earnings in respect of her complaint. CA-00071115-003 Unfair Dismissal The respondent confirmed that she was not employed by the respondent since January 2021 |
Findings and Conclusions:
CA-00071115-002 Payment of Wages The complainant confirmed that there was no financial loss in respect of this complaint. Therefore this complaint is not well founded. CA-00071115-003 Unfair Dismissal The complaint stated that she did not resign from this employer as she accepted that her employment had transferred to another employer. She confirmed that she was not aware of the transfer. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
CA-00071115-002 Payment of Wages Having considered all the written and oral evidence presented in relation to this complaint, my decision is that the complaint is not well founded. CA-00071115-003 Unfair Dismissal Having considered all the written and oral evidence in respect of this complaint, my decision is that the complainant was not unfairly dismissed by this employer. |
