Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 6 of the Payment of Wages Act 1991following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complaint is that the Respondent failed to pay to the Complainant wages properly payable in the period November 2024 to February 2025.
Summary of Complainant’s Case:
The Complainant was employed as a General Operative from 11 January 2022 to 4 February 2025 when his employment came to an end when the company closed. At that time he was owed wages not fully paid from November 2024. He provided an account of wages paid, wages owed and not paid between the period 29 November 2024 and 4 February 2025. He was not paid for the last two weeks of his employment which amounted to €540. He was not paid full wages for the period 18 November to 29 November 2024. The amount of the wages not paid was €2,041.14. He was paid wages in December and not paid for the final two weeks of his employment which he stated was €540 as he was on a short working week.
Summary of Respondent’s Case:
The Respondent did not attend the hearing.
Findings and Conclusions:
The Complainant was not paid his wages in full for the month of November 2024 and the final two weeks of his employment. I find his complaint to be well founded and I require the Respondent to pay to the Complainant the sum of €2,581.14.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 6 of the Payment of Wages Act 1991 requires that I make a decision in accordance with the redress provisions of that Act.
Based on the findings and reasons above, I find the complaint to be well founded and I require the Respondent to pay to the Complainant the sum of €2,581.14.
