Full cross examination of Witnesses was allowed
Background:
The Complainant was employed as a Supermarket Customer Assistant and submitted a complaint that he had been unfairly dismissed.. The Complainant has a stammer and supplied details of his medicine and condition and I have decided, that due to these special circumstances to anonymize the decision. |
Findings and Conclusions:
The Complainant was employed from April 6th 2022 until June 27th 2024. The Complainant submitted his complaint on December 29th 2024. The Respondent objected to the Adjudicator dealing with the substantive complaint on the basis the complaint was submitted out of time and sought a decision on the preliminary matter to avoid time and cost. The cognisable period for the complaint commenced on June 27th 2024 and ended on December 26th 2024. The Complaint was submitted on December 29th 2024 and therefore was out of time.
Section 41 of the Workplace Relations Act 2015 states;
|
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
I find that the complaint was submitted out of time and I have no statutory power to investigate the substantial complaint. |
