Procedure:
These complaints were submitted to the WRC on January 21st 2025 and, in accordance with section 8 of the Unfair Dismissals Act 1977 – 2015 and section 41 of the Workplace Relations Act 2015, they were assigned to me by the Director General. A hearing was arranged for September 4th 2025 at 11.30am for the parties to present evidence in respect of the complaints. The respondent, CivilX Untilities Limited, was represented by Ms Catríona Cannon, BL, instructed by O’Dwyer Solicitors.
The complainant, Mr Artur Gadek, did not attend the hearing. When he had not arrived by 12.00pm, I made enquiries and was informed by his solicitor that he had no instructions with regard to Mr Gadek’s complaints.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
In the circumstances in which the complainant did not attend the hearing, and in the absence of any evidence to the contrary having been submitted, I must conclude that these complaints are not well-founded and I decide accordingly. |
