Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 – 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and SI 359/20206, which designates the WRC as a body empowered to hold remote hearings. In deference to the Supreme Court ruling, Zalewski v Ireland and the WRC [2021] IESC 24 on the 6th of April 2021 the Parties were informed in advance that the Hearing would be in Public, Testimony under Oath or Affirmation would be required and full cross examination of all witnesses would be provided for. The Hearing too place completely in public .
Background:
The Complainant was employed as a Supermarket Customer Assistant and submitted a complaint that he had been discriminated against as a result of his disability. The Complainant has a stammer and supplied details of his medicine and condition to the Hearing and I have decided that due to these special circumstances to anonymize the decision. |
Findings and Conclusions:
The Complainant was employed from April 6th 2022 until June 27th 2024. The Complainant submitted his complaint on December 29th 2024. The Respondent objected to the Adjudicator dealing with the substantive complaint on the basis the complaint was submitted out of time and sought a decision on the preliminary matter to avoid time and cost. The cognisable period for the complaint commenced on June 27th 2024 and ended on December 26th 2024. The Complaint was submitted on December 29th 2024 and therefore was out of time.
Section 41 of the Workplace Relations Act 2015 states;

Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I find that the complaint is out of time and I have no statutory power to deal with the substantive complaint. |
