The application of full terms of the Construction SEO.
BACKGROUND:
This dispute could not be resolved at local level and was the subject of a Conciliation Conference under the auspices of the Workplace Relations Commission. As agreement was not reached, the dispute was referred to the Labour Court on 13 May 2025 in accordance with Section 26(1) of the Industrial Relations Act, 1990.
A Labour Court hearing took place on 14 October 2025.
RECOMMENDATION:
The issue in dispute between the parties is in respect of a claim for a pay review and a pathway in relation to similar terms and conditions as contained in the Construction SEO for this cohort of workers. In the course of the hearing, it was clarified that this referral was the not appropriate forum for a decision in respect of whether these workers were construction workers as defined by the SEO and SIPTU confirmed that they were not seeking such a decision.
The Court notes that a note of outcome that was issued to both parties by the WRC in January 2025 identifies the core areas that need to be addressed and that both parties had done initial responses to same. However, a significant gap in relation to the pathway still remains.
The Court having carefully considered the submissions of the parties and the oral submissions made on the day recommends that the parties have further intense engagement on these issues under the auspices of the WRC for a period of twelve weeks. Should any issues remain outstanding at that point those issues can be referred to the Court in the normal way.
The Court so recommends.
