Procedure:
In accordance with Section 25 of the Equal Status Act, 2000,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complaint alleges discrimination in contravention of the provisions of the Equal Status Act, 2000 in respect of the provision of goods and services in the hospitality sector. |

The complainant did not attend the adjudication hearing and was not represented. |

The respondent was present at the adjudication hearing to put forward its position in relation to the complaint. |
Findings and Conclusions:
The complaint was received by the Director General of the Workplace Relations commission on 8th April 2025 whereby the complainant alleged that the respondent contravened the provisions of the Equal Status Act, 2000 in relation to him. The complaint was assigned the complaint application number CA-00070638-001. The said complaint was referred to me for investigation. A hearing for that purpose was arranged for 21st October 2025. The complainant was notified of the time, date and venue of the adjudication hearing to the email address he included on his complaint form and to another email address that was on file for him. There was no appearance by or on behalf of the complainant at the adjudication hearing. To facilitate the late arrival of the complainant I delayed the commencement of the hearing for approximately 15 minutes but he failed to attend. There has been no further contact from the complainant since the adjudication hearing was due to take place. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
In all of the circumstances of the matter, I must conclude that the within complaint CA-00070638-001 is not well founded and I decide accordingly. |
