Date of Adjudication Hearing: 08/10/2025
Workplace Relations Commission Adjudication Officer: Thomas O'Driscoll
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 Section 79 of the Employment Equality Acts, 1998 - 2015following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints. Neither party showed up at the hearing.
Background:
The Complainant submitted complaints under the Payment of Wages Act 1994 and the Employment Equality Acts 1998-2015 to the Workplace Relations Commission on 3 April 2025. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing to give evidence. |
Summary of Respondent’s Case:
The Respondent did not attend the hearing to give evidence. |
Findings and Conclusions:
I am reasonably satisfied that both the Complainant and the Respondent were informed of the arrangements for the hearing. The Complainant did not attend therefore I find that the complaint under the Payment of Wages Act 1994 was not well founded due to a lack of evidence. Furthermore, I find the Complainant was not discriminated against by the Respondent under the Employment Equality Acts 1998-2018. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act. CA-00070535-002: I find the complaint was not well founded due to a lack of evidence. Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act. CA-00070535-003: I find the Complainant was not discriminated against by the Respondent due to a lack of evidence. |
