Procedure:
In accordance withSection 39 of the Redundancy Payments Acts 1967 - 2014following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:

 The Complainant was made redundant from his position. To date he has not received any redundancy payment. | 
Summary of Complainant’s Case:
| John Daly took the affirmation and gave his evidence as follows: He commenced employment with the Respondent on the 28.02.2003. On the 28.06.2024 he received a letter stating that his position was being made redundancy with immediate effect. At that juncture he was earning €45,000.00 per annum. There was no consultation process. The first he heard about the redundancy was when he got the aforementioned letter. He has not been paid any redundancy to date. |

Findings and Conclusions:
| There was no appearance for or on behalf of the Respondent. I am satisfied that the liquidator was on notice of the hearing. On the 09.10.2025 in response to correspondence from Mr. Garcia Diaz he was informed, in writing, of the date and time of the hearing and that it would be heard remotely. The hearing link had been sent to him prior to that date. 
 I am satisfied based on the Complainant’s evidence that his position was made redundant on the 28.06.2024. His salary was €45,000.00 gross per annum ( €865.38 per week) at the material time. He is entitled to a redundancy payment based on the following: Commencement date: 28.02.2003 Termination date: 28.06.2024 Gross weekly salary: €865.38

Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
| The complaint is well founded. The Complainant is entitled to a redundancy payment as set out above. |
