Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Complainant was employed by the Respondent until the business closed in July 2024. She did not receive her entitlements to redundancy and payment for annual leave and notice.
Summary of Complainant’s Case:
The Complainant stated that she was employed by the Respondent from 22nd July 2021 until 19th July 2024. She was paid €271.20 per week. She only received one-week annual leave in April 2023. She submitted a payslip which showed the amounts of €711.20 holiday pay and €609.60 notice pay. This was her final payslip but she received no payment for those amounts. She also received no payment for statutory redundancy.
Summary of Respondent’s Case:
The Respondent did not attend the hearing.
Findings and Conclusions:
CA-00069411-001 Redundancy Payments Act 1967
The Complainant was let go from her job when the business closed. I find the Complainant is entitled to a statutory redundancy payment.
CA-00069411-002 Payment of Wages Act 1991
The Complainant produced the final payslip in which the amounts outstanding were outlined for payment in lieu of notice and payment for annual leave not taken.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
CA-00069411-001 Redundancy Payments Act 1967
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
Based on the findings above I have decided that the Complainant is entitled to a statutory redundancy payment based on the following criteria:
Date of Commencement: 22 July 2021
Date of Termination: 19 July 2024
Gross Weekly Pay: €271.20
This award is made subject to the complainant having been in insurable employment under the Social Welfare Acts during the relevant period.
CA-00069411-002 Payment of Wages Act 1991
Section 6 of the Payment of Wages Act 1991 requires that I make a decision in relation to the redress provisions under that Act.
Based on the findings above, I have decided that the Complainant is entitled to the total sum of €1,320.80 being wages due for annual leave and payment in lieu of notice.
