Procedure: In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.

Findings and Conclusions:

This complaint is a duplication of the complaint dealt with under ADJ-00055780 which has been decided and published to the parties.

For technical purposes, I am required to formally close this complaint ADJ-00057125 the facts of which have been dealt with under ADJ-00055780. This has been decided and published.

Although it is a duplication, I am still required to issue a decision which can only be not well-founded.

For the sake of clarity, this does not mean that complaint under ADJ-00055780 is affected in any way, that decision stands and is not affected by this technical decision.

Decision:

Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.

For the reasons set out above, where the duplicate complaint, ADJ-00055780, has been well founded, this complaint and previously published. The Duplicate complaint, herein ( ADJ-00057125) is not well founded.
