Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and/or Section 39 of the Redundancy Payments Acts 1967 - 2014 and/or Section 8 of the Unfair Dismissals Acts, 1977 - 2015, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
This matter was heard by way of remote hearing pursuant to the Civil Law and Criminal Law (Miscellaneous Provisions) Act, 2020 and S.I. No. 359/2020 which designates the WRC as a body empowered to hold remote hearings. The respondent and his representative attended the hearing. An interpreter, provided by the WRC, attended the hearing. |

The respondent attended the hearing of this matter and submitted that the employment relationship came to an end due to redundancy and noted that the complainant was entitled to a redundancy payment. |

Findings and Conclusions:
The respondent attended the hearing of this matter and submitted that the employment relationship came to an end due to redundancy. The complainant did not attend the hearing of this matter. CA-00068203-001 Redundancy payment As the complainant did not attend the hearing, he did not provide any evidence of an entitlement to a redundancy payment or other reason to appeal the decision of the respondent. CA-00068203-002 Unfair Dismissal The respondent submitted in advance that the complainant’s employment came to an end by way of redundancy. The complainant did not provide any evidence to suggest that the employment came to an end for any other reason. CA-00068203-003 Payment of Wages As the complainant did not attend the hearing, he did not provide any evidence that the Act was contravened. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
CA-00068203-001 Redundancy payment Having regard to the circumstances of this complaint, my decision is to disallow the complainant’s appeal of the respondents decision. CA-00068203-002 Unfair Dismissal Having regard to the circumstances of this complaint, my decision is that the complainant was not unfairly dismissed. CA-00068203-003 Payment of Wages Having regard to the circumstances of this complaint, my decision is that the complainant has not established that the Act was contravened. |
