Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 andSection 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
| The Complainant worked as a part-time Disc Jockey with the Respondent. | 
Summary of Complainant’s Case:
| The Complainant was employed from 22nd October 2021 until 18th March 2024 for 4.51 hours per week. He was notified the business was closing on 18th March 2024. He requests payment of 38 hours of holidays owed, one week’s notice and statutory redundancy. Payslips evidencing payments were submitted to the Workplace Relations Commission. | 
Summary of Respondent’s Case:
| The Respondent representatives appeared at the hearing, the company was not in a position to pay holidays or other wages owed as Revenue seized the company’s bank assets. The claim is not disputed. | 
Findings and Conclusions:
| I find the complaint is well founded. The Complainant was employed from 22nd October 2021 until 18th March 2024 for 4.51 hours per week receiving 180.40 euro gross per week. He sought a redundancy payment which remains unpaid. In accordance with S39 of the Redundancy Payments Act 1967-2012, I direct that a statutory redundancy payment in respect of this employment be paid by the Respondent to the Complainant. Pursuant to S6 of the Payment of Wages Act 1991, I also direct payment of one week’s notice of 180.40 euro gross, together with arrears of holiday pay due of 1,520.00 euro gross by the Respondent to the Complainant. | 
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
