Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended)following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The Worker referred the present dispute to the Commission on 17th January 2025. In circumstances whereby the Employer did not object to the matter proceedings within the statutory timeframe, the matter proceeded to hearing. Said hearing was convened for, and finalised on, 17th January 2025. There was no appear by or on behalf of the Worker at the hearing as scheduled. |
Summary of Workers Case:
There was no appearance by or on behalf of the Worker at the hearing as scheduled. Having reviewed the file, it is apparent that the Worker was placed on notice of the time, date and venue of the hearing. In circumstances whereby no application for adjournment was received from the Worker, and no explanation of any description was provided in respect of the Worker’s absence, the matter proceeded as scheduled. |
Summary of Employer’s Case:
The Employer stated that they were prepared to contest the complaint raised by the Worker on its merits. Nonetheless, they submitted that the complaint must fail in the absence of any attendance of the part of the Worker. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
In circumstances whereby the Work did not attend the hearing, I do not recommend in her favour. |
Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I do not recommend in favour of the Worker.
