Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
Background:
The worker works on a part-time basis for a County Council. |
Summary of Workers Case:
The worker submits that he has initiated a formal complaint which has not been dealt with by his employer in a fair and efficient manner. |
Summary of Employer’s Case:
The employer submits that it has been unable to deal with the worker’s grievance because the matter has been referred to the WRC. Internal procedures have not yet been exhausted. |
Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
I find the investigation into the worker’s grievance has been put on hold because certain matters were referred to the ERC for investigation. I find it behoves both parties to follow the accepted procedures and complete the task without delay.
I suggest mediation would be helpful as a means of restoring good relations.

Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.
I recommend the parties re-ignite internal mechanisms to bring this dispute to an end.
