Procedure:

In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.

Background:

The Complainant was employed as a Picker from 16 October 2023 until her date of termination on

The Respondent is a limited company and part of a group of companies providing logistics services to a variety of customers

This dispute was one of several complaints filed against a number of companies.

Summary of Workers Case:

It was the Worker’s submission that she was dismissed on 26 January 2024 by the Employer on the grounds of discrimination due to her disability.

Summary of Employer’s Case:

It was the Employer’s submission that it was not the Worker’s employer. Instead, she was under a contract of employment with another entity with a contract of employment signed by the Worker relied upon.

Conclusions:

In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.

I decline jurisdiction where there is no employment relationship between the Worker and the Employer.

Recommendation:

Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.

I find that the Worker was not dismissed from employment with the named Employer.
