Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The Complainant appeared in person at the hearing. There was no appearance by or on behalf of the Respondent. Having reviewed the file I am satisfied the Respondent was on notice of the hearing. |
Summary of Complainant’s Case:
The Complainant was employed as a Bus Driver by the Respondent from 30 January 2023 to 10 February 2025 and was paid fortnightly at a gross rate of €1, 687.80. He was dismissed on 10 February 2025. The Complainant submitted that he assigned to the 3.50am route from Tallaght to Dublin Airport. When he could not log on to the Respondent’s app to confirm the number of the bus he was due to pick up, he became concerned. He then noted there were messages from his colleagues via WhatsApp that the Respondent was ceased trading. The message was sent in or around 10pm the night before on 9 February 2025 but he was asleep. |
Summary of Respondent’s Case:
Having waited a reasonable period of time, again there was no appearance by or on behalf of the Respondent. |
Findings and Conclusions:
I find that the Complainant is entitled to a redundancy lump sum payment pursuant to the Redundancy Payments Acts 1967. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
I direct the Respondent to pay the Complainant a redundancy lump sum payment under the Redundancy Payments Act 1967 calculated on the basis of the following information. The Complainant commenced employment on 30 January 2023. The Complainant’s received notice on 10 February 2025. The Complainant’s employment terminated on 24 February 2025 (to account for the Complainant’s minimum notice period). The Complainant was paid fortnightly at a gross rate of €1, 687.80 based on a 40 hour week. |
