Workplace Relations Commission Adjudication Officer: Michael MacNamee
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 39 of the Redundancy Payments Acts 1967 - 2014 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The above claims were initiated by way of Workplace Relations Complaint form which was received by the Workplace Relations Commission on the 28th of May 2025. |
Summary of Complainant’s Case:
There was no appearance by or on behalf of the Complainant |
Summary of Respondent’s Case:
There was no appearance by or on behalf of the Respondent |
Findings and Conclusions:
The matter was listed for hearing in the offices of the Workplace Relations Commission on the 10th of November 2025. There was no appearance by or on behalf either party. Having ascertained that the parties were on notice of the time, date and venue for the adjudication hearing, I proceeded in the absence of the parties. As there was no appearance by or on behalf of the Complainant, the Respondent has no case to answer, and accordingly the Complainants CA-00071971-001, 003 and 004 are not well-founded. As regards the claim pursuant to the Redundancy payments Acts - CA-00071971-002 - the Complainant’s appeal is not upheld. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
CA-00071971-001 – Complaint not well-founded CA-00071971-002 – Complainant’s appeal is not upheld CA-00071971-003 – Complaint not well-founded CA-00071971-004 – Complaint not well-founded |
