Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
The hearing was held online.
Summary of Complainant’s Case:
The complainant gave evidence on affirmation.
She submitted that Leafwell Ltd is owned and operated by Taleta Ltd and the owners of the company were identified.
The café stopped opening entirely without any explanation and there was no communication with staff about whether it would reopen.
She said that she had not been paid for three weeks, in two of which she worked for thirty eight and a half hours and in the third for forty four; a total of one hundred and twenty one hours in total.
Relevant bank statements and other documents were submitted in support of this complaint. Her hourly rate was €13.50.
The respondent also failed to pay her orforheraccruedholidayentitlement, a total of eight days was left outstanding.
She also complained that she was not given proper premium pay for working on public holidays. |

Findings and Conclusions:
The business closed suddenly and, according to the complainant’s evidence, despite promises that she would be paid, nothing happened. More than seven other employees were affected.
The complainant gave credible evidence on affirmation.
Although it was imprecise in relation to public holidays and I can make no finding in that regard, and I find as follows in relation to outstanding wages and annual leave.
She is owed wages that were properly payable to her in respect of one hundred twenty-one hours in total at her hourly rate of €13.50.; a total in respect of wages €1633.50.50.
In respect of her annual leave, a total of eight days was left outstanding. I calculate her daily rate (based on a 38.5-hour week) to be €182.25 and accordingly award her €1,458 in respect of annual leave due to her.
In total she is due €3091.50. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Complaint CA-00071394-001 is well founded and I award the complainant a total of €3091.50. |
