Procedure:
In accordance with Section 25 of the Equal Status Act, 2000, following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Complainant initiated this claim by way of Workplace Relations Complaint Form received by the Workplace Relations Commission on the 17th of April 2025. The Complainant sought relief pursuant to Section 21 of Equal Status Act, 2000 (as amended) |
Summary of Complainant’s Case:
There as no appearance by or on behalf of the Complainant at the adjudication hearing. |
Summary of Respondent’s Case:
The Respondent was represented by its C.E.O Mr. Larry Timmons. The Respondent’s general manager Mr. Justin Park was also in attendance. The Respondent sought to oppose the complaint was ready to proceed. |
Findings and Conclusions:
The matter was listed for hearing in the offices of the Workplace Relations Commission on the 10th of November 2025. There was no appearance by or on behalf of the Complainant. The Respondent was in attendance and ready to proceed. Having ascertained that the Complainant was on notice of the time, date and venue for the adjudication hearing, I proceeded in the absence of the Complainant. As there was no appearance by or on behalf of the Complainant, the Respondent has no case to answer, and accordingly I find that the Respondent did not engage in prohibited conduct.

Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
