Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant was employed with the Respondent as a House-keeper from 3rd March 2022. |
Summary of Complainant’s Case:
The Complainant alleges that she has been discriminated against and victimised by the Respondent on 13th January 2025 on the grounds of her civil status, in relation to training, and her conditions of employment. |
Summary of Respondent’s Case:
The Respondent says it was unaware of any dispute or grievance on the part of the employee until it received notification from the Workplace Relations Commission. The Respondent says it has a grievance procedure which is available for all staff in their Employee Handbook but this was never used by the Complainant. They are unaware of any complaint from the Complainant but believe she may have been dissatisfied by the outcome of a disciplinary procedure. |
Findings and Conclusions:
I have considered the written submissions of the parties. This matter came before me on 1st May 2025. There was no appearance by or on behalf of the Complainant at the hearing. The Respondent requested that the complaint be dismissed given the non-attendance of the Complainant. The Workplace Relations Commission subsequently wrote to the Complainant requiring her to provide substantial grounds to explain her non-appearance at the hearing within seven days. No response was received from the Complainant. I am satisfied the Complainant was served with notice of the hearing date. In the circumstances, I must dismiss the complaint for want of prosecution by the Complainant. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
I dismiss the complaint for want of prosecution by the Complainant. |
