Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant is an emergency medical technician. |
Summary of Complainant’s Case:
The Complainant was taken on by the company on 10th June 2024. She complains that she was discriminated against due to her family status, sexual orientation, body size and appearance. A derogatory comment was made about her blue hair when she met a member of the Respondent. She had carried out the role for two and a half years previously. Following meeting the representative, she says he overheard her discussing her family status, she was given a short service dismissal. |
Summary of Respondent’s Case:
The Respondent disputes the complaint of discrimination and says there is insufficient evidence provided by the Complainant to support the claim. The Respondent says the Complainant has failed to raise a prima facie discrimination claim. |
Findings and Conclusions:
I heard the submissions of the Respondent at the hearing. There was no appearance by or on behalf of the Complainant at the hearing. I am satisfied the Workplace Relations Commission wrote to the Complainant notifying of the hearing, and requesting an explanation for non-appearance, but none was received. In the circumstances, I dismiss the complaint. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
The complaint is dismissed. |
