Procedure:
This complaint was submitted to the WRC on January 16th 2025 and, in accordance with Section 8 of the Unfair Dismissals Act 1977 – 2015, it was assigned to me by the Director General. A hearing was arranged for May 23rd 2025 at 11.00am, for the parties to present evidence in respect of the complaint. The respondent, Mercer Premier Services Limited, was represented by Mr Ian McGowan Smyth of HR Ireland. Mr McGowan Smyth was accompanied by a company director, Ms Cepta Ryan.
The complainant, Mr Michael Clare, did not attend the hearing. When he had not arrived by 11.30am, I made enquires and I was informed by a member of the administration team that, at 05.34 on the morning of the hearing, he sent an email to the WRC in which he said that he would not be attending due to “an overnight family matter.”
Decision:
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
In the circumstances in which the complainant did not attend the hearing and, in the absence of any evidence to the contrary having been adduced before me, I must conclude that this complaint under the Unfair Dismissals Act 1977 – 2015 is not well-founded and I decide accordingly. |
