Procedure:
In accordance with section 41 of the Workplace Relations Act 2015,following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Mairéad Ní Neachtain (the “complainant”) did not attend a hearing arranged for 8 May 2025. MP Guinness BL, instructed by Claire McDermott of Flynn O’Driscoll LLP, attended the hearing representing the interests of Gael Linn Teoranta (the “respondent”) along with the respondent’s HR Manager.
Background:
The complainant referred a complaint to the Workplace Relations Commission under section 6 of the Payment of Wages Act 1991.
By way of written submissions on behalf of the respondent, the complaint against the respondent was fully disputed and a preliminary issue raised that the complaint had been referred to the Commission outside of the statutory time limit for presentation of a complaint. |
Findings and Conclusions:
By correspondence dated 19 March 2025, the Commission notified the parties of the hearing arrangements for 8 May 2025. The respondent’s legal representatives and HR Manager attended the hearing. The complainant did not attend the hearing. After allowing some time for any delay on the part of the complainant, I closed the hearing. I am satisfied that the complainant was properly notified of the hearing arrangements in accordance with the contact information provided. Submissions received on behalf of the respondent were exchanged with the complainant prior to the hearing. The complainant did not contact the Commission to indicate any difficulty on their part in attending the hearing, or to explain their non-attendance. Based on the complainant’s non-attendance at the hearing on 8 May 2025, I must conclude that the complaint against the respondent is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
For the reasons set out above, my decision is that the complaint against the respondent is not well founded. |
