Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 and Section 25 of the Equal Status Act, 2000 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complaint was initiated against the Respondent by Workplace Relations Complaint form received by the Workplace Relations Commission on the 11th of December 2024. The Complaint alleged that the last act of discrimination had occurred on the 2nd of December 2024. |
Summary of Complainant’s Case:
There was no appearance by or on behalf of the Complainant at the adjudication hearing. |
Summary of Respondent’s Case:
On the 24th of March 2025 the Respondent provided a written submission prepared by Mr. Brian Heavy the Director of Real Entertainment Limited, 18 Eustace Street, Temple Bar, Dublin 2 which company organises Language Exchange Ireland events. The submission denied that any prohibited conduct had occurred. |
Findings and Conclusions:
The matter was listed for hearing before me at the offices of the Workplace Relations Commission in Lansdowne House on the 11th of April 2025. On that date there was no appearance by or on behalf of the Complainant. The Respondent was present and ready to proceed having delivered a written submission in advance of the hearing. Having ascertained that the Complainant was on notice of the time date and venue for the adjudication hearing, I proceeded in the absence of the Complainant.
In the absence of the Complainant the Respondent has no case to answer. Accordingly, I find that the Respondent did not engage in prohibited conduct. |
Decision:
Section 25 of the Equal Status Acts, 2000 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 27 of that Act.
