Procedure:
In accordance with section 39 of the Redundancy Payments Acts 1967 – 2014, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The complainant referred to the Workplace Relations Commission a complaint for adjudication under section 39 of the Redundancy Payments Act 1967, as amended.
There was no attendance by either party at the hearing arranged by the Commission. |
Findings and Conclusions:
By correspondence dated 4 April 2025, the Commission notified the parties of the hearing arrangements for 15 May 2025. The correspondence to the respondent’s liquidator was returned undelivered, and the Commission subsequently informed the liquidator of the hearing arrangements by email to the contact details provided. I am satisfied that the parties were informed of the hearing arrangements in accordance with contact detail provided. No communication was received from either party in relation to their non-attendance at the hearing. In circumstances where it was necessary for the complainant to attend the hearing in pursuit of his complaint, I must conclude that the complaint against the respondent is not well founded. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
For the reasons set out above, I find that the complaint under the Redundancy Payments Act 1967 is not well founded. |
