Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant worked for the employer from 28th March 2024 until 14th June 2024. |
Summary of Complainant’s Case:
The Complainant worked as a window-cleaner for the employer. He says the employment impacted negatively on his mental health and his physical health. He had to obtain physiotherapy to fix his back. The Complainant says 925.66 euro wages, 925.66 euro for one week’s notice and 600 euro holiday pay was due in June 2024. This is still unpaid by the employer. |
Summary of Respondent’s Case:
Mr. Needham and Byrne attended the hearing on behalf of the employer. They said there was a difficulty getting paid for work done at the time and they had no money to pay the Complainant. They needed to let the Complainant go at the time due to various issues. They submitted a calculation of payments and accept holiday pay of 435.60 gross euro and notice of 418.85 gross euro is due to the Complainant. |
Findings and Conclusions:
I heard and considered the submissions of the Respondent. The Respondent accepts holiday pay of 435.60 gross and notice of 418.85 gross euro is due to the Complainant. The monies owed total 854.45 gross euro for arrears of wages should be paid by the Respondent to the Complainant immediately. There was no appearance by or on behalf of the Complainant at the hearing. Following the hearing, the Workplace Relations Commission wrote to the Complainant requesting an explanation and to provide grounds for non-appearance. There was no response by or on behalf of the Complainant. The Complainant was not present to pursue his complaint, I make no order pursuant to S41 of the Workplace Relations Act 2015. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is not well founded. |
