Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.

The complainant did not attend the adjudication hearing and was not represented. |

The respondent attended the adjudication hearing and was prepared to put forward its position in relation to the complaint. |
Findings and Conclusions:
The complaints were received by the Director General of the Workplace Relations commission on 11th April 2024 whereby the complainant alleged that the responded contravened the provisions of the Protected Disclosures Act, 2014 in relation to her. The complaint was assigned the complaint application number CA-00062736-001. The said complaint was referred to me for investigation. A hearing for that purpose was arranged for 10th April 2025. There was no appearance by or on behalf of the complainant at the hearing. In advance of the hearing taking place, the complainant sought that the hearing be postponed on the basis that she was seeking to have the respondent joined to a separate adjudication decision that is before the Labour Court on appeal. The complainant was advised that her application for a postponement of the hearing was refused and that the hearing at first instance against the named respondent would proceed as scheduled. In my view, when the postponement application was refused, it was incumbent on the complainant to attend the adjudication hearing to pursue her complaint. The complainant did not do so. On that basis, I find that the complaint is not well founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
In all of the circumstances of the matter, I must conclude that the within complaint (CA-00062736-001) is not well-founded and I decide accordingly. |
