Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
I conducted a remote hearing in accordance with the Civil Law and Criminal Law (Miscellaneous Provisions) Act 2020 and Statutory Instrument 359/2020 which designates the Workplace Relations Commission as a body empowered to hold remote hearings.
Background:
The Complainant was initiated by Workplace Relations Complaint Form received by the Workplace Relations Commission on the 27th of March 2023. The Complainant made a single claim pursuant to Section 6 of the Payment of Wages Act 1991 in respect of salary which had not been received and which was due to be paid on the 10th of March 2023.
At an initial hearing on the 14th of July 2023 there was no appearance by or on behalf of the Respondent. Being satisfied that the Respondent was, I proceeded in the absence of the Respondent. The hearing was adjourned to allow the Complainant to make further submissions but the Complainant did not do so. The matter was relisted for online hearing for the 15th of May 2025. On that date neither party appeared or was represented. I was satisfied that both parties were on notice of the date, time and venue for the adjudication hearing but as neither party was present the hearing concluded. |

Findings and Conclusions:
As there was no appearance by or on behalf of the Complainant the Respondent has no case to answer. Accordingly I find that the Complainant’s claim is not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
