Procedure:
In accordance with Section 41 of the Workplace Relations Act, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant gave evidence on affirmation.
He quit his employment with the respondent on October 25th, 2024, after some seven or eight years employment. He was paid €13.50 per hour.
He says that about six months before he resigned there had been a pattern of wages being paid late and he had raised this with the respondent on a number of occasions. Eventually he advised the respondent that he was leaving following an occasion when he had not been paid for some weeks, as he needed consistency in the payment of his wages.
Some outstanding monies were paid but €2663.76 remains outstanding comprising €1745.96 in wages and €917.40 in annual leave payments. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. No explanation was received for his failure to do so. |
Findings and Conclusions:
As noted above the complainant gave evidence on affirmation and gave a credible account of the facts underlying his complaint.
I am satisfied that the payments specified; are properly payable and due to him and I decide accordingly.
I order the respondent to pay the complainant €2663.74 subject to normal statutory deductions. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Complaint CA-00067353-001 is well founded and I order the respondent to pay the complainant €2553.74 in wages due to him subject to normal statutory deductions |
