Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 – 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submitted a complaint of alleged discrimination relating to age and promotion but did not attend the Hearing. The Respondent attended the Hearing and denied the complaint. |
Findings and Conclusions:
A Complaint was received by the Director General of the Workplace Relations Commission by the Complainant on September 7th 2024 alleging that her former employer contravened the provisions of the Employment Equality Act 1998 in relation to her. The said complaint was referred to me for investigation. A Hearing for that purpose was held on June 10th 2025. There was no appearance by or on behalf of the Complainant at the Hearing. I am satisfied that the said Complainant was informed in writing of the date, time and place at which the Hearing to investigate the complaint would be held and were not present at the Hearing. |
Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
As the Complainant was not present to give any evidence to support her complaint and the Respondent denied the complaint, I find that the Respondent did not engage in an act of discrimination and the complaint is not well founded. |
