In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
This case concerns complaints which overlap with those determined in ADJ-00051909 concerning the same Complainant but a different Respondent. |
Summary of Complainant’s Case:
The Complainant submits that her employer was the Respondent identified in ADJ-00051909. |
Summary of Respondent’s Case:
The Respondent submits that the Complainant was formerly an employee of the Respondent but that relationship ended in September 2017. |
Findings and Conclusions:
It has been determined in two separate WRC cases, ADJ-00051909 and ADJ-00055881, that the Complainant was not an employee of the Respondent during the period of the alleged breach of these acts. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaints are not well founded. |
