BACKGROUND:
The Worker appealed the Decision of the Adjudication Officer to the Labour Court on 13 November 2024 in accordance with Section 8A of the Unfair Dismissals Act 1977 to 2015. A Labour Court hearing took place on 24 June 2025. The following is the Decision of the Court.
DECISION:
1 Background to the Appeal
This is an appeal by Ms Kerr (the Complainant) against Adjudication Officer’s Decision ADJ-00051170 CA-00062818-001 given under the Unfair Dismissals Acts 1977 to 2015 (the Act’s) in a claim against her previous employer Halcyon Cleaning Services Ltd (the Respondent) that she was unfairly dismissed. The Adjudication Officer held that her complaint was not well founded.
The complaint was lodged with the WRC on 26 January 2024, appealed to the Labour Court 13 November 2024 and a hearing was scheduled for 11.00am on 24 June 2025.
On the morning of the hearing at 10.00am the Complainant emailed the Court to say she would not be attending but did not withdraw her appeal. The hearing opened at 11.00am as scheduled. The Complainant was not present to move her appeal and therefore her appeal fails.
The appeal fails. The decision of the Adjudication Officer is upheld.
The Court so determines.
