Procedure:
In accordance with Section 13 of the Industrial Relations Act 1969 (as amended) following the referral of the dispute to me by the Director General, I inquired into the dispute and gave the parties an opportunity to be heard by me and to present to me any information relevant to the dispute.
1: Opening Note – Non Appearance by the Worker
The Worker, despite being properly notified of the Date, Time and Place of the Hearing did not attend. No Bona Fide explanations were received, in the three week period post the Hearing at the WRC, to explain the non-attendance.
Accordingly, as no evidence was presented the Dispute is deemed Legally Not Properly Founded.
It could not proceed.
2: Conclusions:
In conducting my investigation, I have taken into account all relevant submissions presented to me by the parties.
As no evidence was presented the Dispute could not proceed. |
3: Recommendation:
Section 13 of the Industrial Relations Act 1969 requires that I make a recommendation in relation to the dispute.

The Recommendation is that the case could not proceed. It has to be set aside.
