Workplace Relations Commission Adjudication Officer: Brian Dalton
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s).
Background:
The Complainant brings the following complaints: CA-00069247-001: The employer did not pay for the final week and accrued annual leave. They sent me two payslips (one for the final week and another for holidays but no transaction was made from for that). CA-00069247-002: The employer did not give me the statement of the terms and conditions of my employment. CA-00069247-003: I did not receive the statement of core terms of employment. The Complainant consented to email communication and was contacted by the email provided about the date, time and place of the hearing. The Respondent was contacted at the address provided: Jpm Secretarial Ltd, Pembroke Hall Town: 38/39 Fitzwilliam Square County Dublin 2 Country Ireland Postcode: D02 NX53. The Complainant failed to attend and the Respondent failed to attend. The Respondent failed to attend and I note from the Company Registration Office that that a Liquidator was appointed by Court Order on or about 4th of April 2025. |
Summary of Complainant’s Case:
The Complainant failed to attend to make out their case. |
Summary of Respondent’s Case:
The Respondent failed to attend; although, notified at their registered address. |
Findings and Conclusions:
As the Complainant failed to attend all complaints must be dismissed for failure to attend. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
I dismiss the complaints arising from the failure of the Complainant to attend at the hearing. I am satisfied that he was notified of the date, time and place of the hearing I determine that the following complaints are not well founded: CA-00069247-001: The employer did not pay for the final week and accrued annual leave. They sent me two payslips (one for the final week and another for holidays but no transaction was made from for that). CA-00069247-002: The employer did not give me the statement of the terms and conditions of my employment. CA-00069247-003: I did not receive the statement of core terms of employment.
