Procedure:
In accordance with Section 79 of the Employment Equality Acts, 1998 - 2015, following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
In deference to the Supreme Court ruling, Zalewski v Ireland and the WRC [2021] IESC 24 on the 6th of April 2021 the Parties were informed in advance that the Hearing would normally be in Public, Testimony under Oath or Affirmation would be required and full cross examination of all witnesses would be provided for.
This complaint was the subject of two hearings. The first hearing took place on 1 May 2025. Both the complainant and the respondent attended this hearing. Although no request had been made by the Complainant prior to the hearing for the assistance of an interpreter, at the outset of the hearing it became obvious that there was a requirement for an interpreter to assist the complainant. That being the case the hearing was adjourned to allow for the attendance of an interpreter at a re-scheduled hearing.
A second hearing was scheduled for and took place on 5 June 2025. The respondent attended this the hearing; the complainant did not.

Findings and Conclusions:
A complaint was received by the Director General of the Workplace Relations commission from Mr Chittranjan Kumar Sharma on 30 December 2024 alleging that his former employer Pattina Products Limited, contravened the provisions of the Employment Equality Act, 1998, in relation to him. The said complaint was referred to me for investigation. A hearing for that purpose was held on 5 June 2025. There was no appearance by or on behalf of the complainant at the hearing. I am satisfied that the said complainant was informed in writing of the date, time and place at which the hearing to investigate the complaint would be held. In these circumstances and in the absence of any evidence to the contrary having been adduced before me, I must conclude that the within complaint is not well-founded and I decide accordingly.

Decision:
Section 79 of the Employment Equality Acts, 1998 – 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under section 82 of the Act.
The complainant was not discriminated against. |
