Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant submitted the within claim under section 27 of the Organisation of Working Time Act, 1997, on 23rd of October 2024. A Hearing of the claim was held on 24th of February 2025.

Summary of Complainant’s Case:
The complainant was not in attendance at the hearing. |
Summary of Respondent’s Case:
The respondent was in attendance at the hearing but as the Complainant did not attend on the day of the hearing to give evidence in relation to his complaint, the Respondent did not present any evidence at the hearing. |
Findings and Conclusions:
On review of the correspondence on file I am satisfied that the Complainant was notified of the hearing date and time. I waited some time to accommodate a late arrival. As there was no appearance by the Complainant, I closed the hearing. The Complainant did not contact the WRC in advance of or in the days following the scheduled hearing to indicate any difficulty with attending the hearing. The complainant failed to attend the hearing to pursue his case. In the circumstances I am satisfied that the complaint should fail. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
The Complainant offered no evidence and did not attend at the hearing. Accordingly, I declare this claim to be not well founded. |
