Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
The Complainant worked with the company from 6th November 2023 until 20th August 2024. |
Summary of Complainant’s Case:
The Complainant worked with the company until she was informed it was closing on 25th August 2024. It closed on 20th August 2024. She is owed holidays of 68.60 hours which is two weeks pay total 960.40 euro gross. |
Summary of Respondent’s Case:
There was no appearance by or on behalf of the Respondent. |
Findings and Conclusions:
I heard and considered the submissions and evidence of the Complainant. The Complainant gave evidence that she was not paid two weeks holiday due in August 2024 pursuant to S27 of the Organisation of Working Time Act 1997. She submitted bank statements evidencing failure of the company to pay her holidays. I find the complaint is well founded and direct payment of 960.40 euro gross to the Complainant by the Respondent. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
