Procedure:
These complaints were submitted to the WRC on March 3rd 2024 and, in accordance with section 8 of the Unfair Dismissals Act 1977 – 2015 and section 41 of the Workplace Relations Act 2015, they were assigned to me by the Director General. A hearing was arranged for June 27th 2025, for the parties to present evidence in respect of the complaints; however, neither the complainant nor the respondent attended. I note from the case file that, on May 14th 2025, both parties were informed in writing of the date, time and place at which the hearing to investigate the complaints would be held. Neither party contacted the WRC to explain their non-attendance.
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
Section 8 of the Unfair Dismissals Acts, 1977 – 2015 requires that I make a decision in relation to the unfair dismissal claim consisting of a grant of redress in accordance with section 7 of the 1977 Act.
In the circumstances where the parties did not attend the hearing and, in the absence of any evidence to the contrary having been presented before me, I must conclude that these complaints are not well-founded and I decide accordingly. |
