Complaint seeking adjudication by the Workplace Relations Commission under Section 18 of the Protection of Young Persons (Employment) Act, 1996 | CA-00072178-001 | 06/06/2025 |
Date of Adjudication Hearing: 02/12/2025
Workplace Relations Commission Adjudication Officer: David James Murphy
Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Background:
The Complainant submitted the above complaint following a dispute with the Respondent related to leave. |
Summary of Complainant’s Case:
The Complainant did not attend the hearing. |
Summary of Respondent’s Case:
As the Complainant did not attend the hearing the Respondent did not have an opportunity to respond to his complaint. |
Findings and Conclusions:
When the Complainant submitted his complaint he provided the WRC with an email address and consented to being notified of hearing dates by way of that email address. The WRC records show a hearing notification was sent to him on the 10th of November 2025. The Complainant did not attend the scheduled hearing date. I got in touch with him via the mobile number provided on his complaint form and he indicated he did not want to request the matter to be relisted and would withdraw his complaint in writing. He has not done so and I have proceeded to issue a decision closing the matter on the basis of his failure to attend the hearing. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
The complaint is not well founded. |
