Procedure:
In accordance with Section 39 of the Redundancy Payments Acts 1967 - 2014following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Summary of Complainant’s Case:
The complainant gave evidence on affirmation.
She had been manager of the delicatessen in the business which was a service station and a retail shop.
Her place of employment was taken over by new owners, following which she was made redundant on September 7th, 2024.
She was told that she would get a redundancy payment but heard nothing since.
She has made numerous attempts to contact the respondent, but they have been ignoring her calls and messages.
There was an offer of ten hours a week in the shop which was not acceptable as she had been working forty hours per week, and she needed full-time work. |
Summary of Respondent’s Case:
The respondent did not attend the hearing. I am satisfied that proper notice was served of the hearing on the respondent. |
Findings and Conclusions:
I find that the complainant ‘s employment was terminated by reason of redundancy and her evidence on affirmation was that she had not been given a redundancy payment as promised.
I find that she is entitled to a redundancy payment in accordance with the terms of the Redundancy Payments Act based on her continuous service from March 15th, 2017, until September 7th, 2024. Complaint CA-00072416-001 is well founded. |
Decision:
Section 39 of the Redundancy Payments Acts 1967 – 2012 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under that Act.
Complaint CA-00072416-001 is well founded. The complainant is entitled to a redundancy payment in accordance with the terms of the Redundancy Payments Act based on her continuous service from March 15th, 2017, until September 7th, 2024. |
