Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Background:
This complaint began on the 16th of January 2025. Permission was given for the Respondent to amend their submission, and a new date was set down. However, arising from requests for postponements the matter was heard on the 17th of November 2025. The Complainant failed to attend the hearing. The Complainant consented to email communication, and I am satisfied that she was informed of the date, time and place of the hearing.
The Respondent did attend and was ready to rebut the allegations being made against them.
In these circumstances the case must be dismissed for failing to attend. |

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint in accordance with the relevant redress provisions under Schedule 6 of that Act.
I dismiss the case arising from the non-attendance at the hearing having been properly notified of the date, time and place of the hearing. As no case was presented or evidence given by the Complainant the complaint must be dismissed for failure to attend. I determine that the complaint is not well founded. |
