SUBJECT:
Referral under Section 20(1) of the Industrial Relations Act 1969.
BACKGROUND:
The Worker referred this case to the Labour Court on 11 November 2024 in accordance with Section 20 (1) of the Industrial Relations Act, 1969 and agreed to be bound by the Court’s Recommendation.
A Labour Court hearing took place on 01 July 2025.
RECOMMENDATION:
Background to the Dispute
The within dispute was referred to the Court under section 20(1) of the Industrial Relations Act 1969. The Court convened a hearing in Cork on 1 July 2025 to investigate the dispute. There was no appearance by or on behalf of Horizons Cork (‘the Employer’) (previously known as Cope Foundation). The Worker is alleging inter alia that the Employer failed to follow its established grievance procedure in respect of an issue that she sought to raise arising from an internal promotional competition in which she was unsuccessful.
Discussion and Recommendation
In the course of the hearing, the Court was informed by the Union Representative that the issue of the Employer’s alleged non-compliance with the established grievance procedure, being an apparent breach of a national agreement, had been referred to the National Joint Council and that that issue was still in process as of the date of the within hearing.
The Court recommends that the NJC referral should take its course and, in the event that any issues remain in dispute between the Worker and her Employer thereafter, the Worker can refer them to the Court at that stage for a Recommendation.
The Court so recommends.
